Asylum law in Cologne

In asylum proceedings the hearing and the deadlines often decide everything. We support you from the asylum application and the hearing at the BAMF to the court action and urgent proceedings before the administrative court – in German and Turkish.

Typical matters

  • Asylum application and hearing at the BAMF
  • Refusal of the asylum application: action and urgent application (Eilantrag)
  • Dublin procedure (responsibility of another EU state)
  • Subsequent and second applications
  • Protection status: refugee protection, subsidiary protection, bans on deportation
  • Revocation and withdrawal of protection status

Important: Decisions of the BAMF contain very short deadlines, often only one or two weeks. Do not leave the decision lying around; come to us as soon as possible with the envelope.

Good to know

  • Prepare the hearing carefully: reasons for flight, dates, places and evidence. Inconsistencies or gaps can later be used against you.
  • Have the hearing record translated back to you and report errors or misunderstandings immediately.
  • Watch your post. A decision may be deemed served even if you have not read it. Deadlines run regardless.

Competent bodies: Actions and urgent applications against decisions of the BAMF go to the competent administrative court, depending on your place of residence or accommodation.

Frequently asked questions

How long do I have to take legal action against a refusal?

Usually two weeks from service. For decisions marked “manifestly unfounded” or “inadmissible” only one week, and an urgent application is then also needed. The exact deadline is stated in the decision.

How important is the hearing at the BAMF?

Very important. Your account of the reasons for flight is usually the basis of the decision. Prepare, describe what you experienced completely and comprehensibly and seek advice beforehand.

What is a Dublin decision?

With a Dublin decision the BAMF does not examine your application on its merits because another EU state is supposed to be responsible. There are only very short deadlines against it, often one week for the urgent application. Act immediately.

Can I still file a new application after a refusal?

Under certain conditions a subsequent application is possible, for example with new facts or evidence. We check case by case whether that makes sense.
