Criminal law in Cologne

Anyone who becomes a suspect in an investigation or criminal proceedings should seek legal advice early. We defend you from the first interview to the main trial.

Typical matters

  • Summons or hearing as a suspect
  • Investigations by the police and public prosecutor
  • Penal order (Strafbefehl) and objection
  • Main trial before the local or regional court

Important: As a suspect you have the right to remain silent. Do not make any statements on the matter before you have spoken to an attorney.

Good to know

  • File access: A defence lawyer can generally apply for access to the investigation file. Only then can the defence be planned sensibly.
  • Do not discuss the allegation with witnesses or others involved. It can be misinterpreted later.
  • Do not delete messages, photos or documents. They may be important for the defence.

Competent bodies: Depending on the allegation and place of the offence, the Cologne local court (Amtsgericht) or regional court (Landgericht) is competent; the public prosecutor conducts the investigation.

Frequently asked questions

Do I have to go to the police if I receive a summons?

Suspects generally do not have to appear at a police summons or make any statements. Have the letter checked by a lawyer first.

Do I need a lawyer if I am only a witness?

As a witness you are generally obliged to testify. In certain cases you may refuse to answer, for example if you would incriminate yourself. If in doubt, seek advice beforehand.

What is a penal order (Strafbefehl)?

A penal order is a court decision made without a main trial. You can object within two weeks of service; otherwise it becomes final.

When should I get in touch?

As early as possible, ideally before your first statement. The earlier the defence begins, the more options there are.
